Hands-on Training on Patent Drafting (July 18-20, 2018)

In order to create awareness of step-by-step procedure to protect an idea via appropriate intellectual property filing, it’s mandatory to perform the prior-art search of the technology/ innovation etc. followed by appropriate IP filing. This thought culminated into conducting of this training for obtaining patents in India (National Phase & PCT filings too), different types of forms required, fees schedule etc. This training aimed to enable participants to draft patent applications at individual level and to provide acquaintance regarding patent prosecution matters.

Agenda
The programme agenda included:
1. Introduction to IPR
2. International Treaties, TRIPS Agreement, US Patent System, European Patent System
3. Indian Patent System and Indian Patent Office
4. Prior-Art Search with Exercises
5. Drafting of Patent Specification, Claims Drafting with Practical Exercises
6. Responses to Examination Reports with Practical Exercises and Claim Interpretation/ Infringement

Resource Persons
The lectures and practical of the training were taken by the patent attorneys, staff of TIFAC, subject matter experts etc. The list of resource persons included eminent experts from IP field that is:

a. Dr. S. P. Arora, Patent Attorney, Global IPR Law Consultants
b. Dr. Sangeeta Nagar, Scientist E, TIFAC
c. Ms. Dipti, Principal Training Co-ordinator, TIFAC
d. Dr. Anushri Gupta, Founder Member, Anushri Gupta & Associates

Participants
The training witnessed twenty-one participants namely students, industry personnel, scientists, academicians etc. from various locations of India which enthusiastically got acquainted to patent drafting and patent searching. The participants included Principal Scientists from various Divisions of IARI viz. Entomology, Plant Pathology, Plant Physiology, Agricultural Chemicals, Nematology and industry persons i.e. from M/s. Dayal Fertilizers, M/s. PI Industries, M/s. Unison Agrico, M/s. STEP etc. Two participants belonged to Zonal Institutes of IARI i.e. Indian Institute of Wheat & Barley Research, Karnal and Indian Grassland & Fodder Research Institute, Jhansi. PhD students and few scientists from other govt. institutes also participated.

Training Description
On first day of the training, sessions were taken by Dr. S. P. Arora, registered patent Agent/Attorney. His morning sessions comprised of Introduction to IPR, International Treaties, TRIPS Agreement, US Patent System and European Patent System. Dr. Arora covered each topic very comprehensively and made sure every participant grasped it well.

In afternoon of same day, Dr. Arora took topic of ‘Indian Patent System and Indian Patent Office’ and elaborately discussed how effectively our Patent Office works in handling and management of Patents filed in it.

On second day, Dr. Sangeeta Nagar, Scientist E of TIFAC gave an overview of ‘Basics of Patent Prior-Art Search’ followed by prior-art searching exercises. In the session of basics of patent prior-art search Dr. Sangeeta demonstrated what the patentability criteria are and how to check them. After this session TIFAC team gave practical session on patent prior-art searching. Each participant was individually taught to search prior-art by the exercise sheet given to them. In second half too the same session continued for more than one hour.

After the above session, Dr. Anushri Gupta, Founder Member, Anushri Gupta & Associates gave a session on ‘Biotechnology Guidelines for Patent Filing in India and Patentability Issues in Biotechnology’ in which she addressed guidelines to comply before filing biotechnological inventions in India. She also covered treaties and laws related to biotechnological inventions and patentable subject matter of biotechnology.

On the last day of training, Dr. S. P. Arora took sessions on patent drafting, First Examination Report responses drafting, claims interpretation etc. The training concluded with vote of thanks to the resource person and IPFC team followed by certificate distribution to the participants.

Analysis
Positive responses were received by the participants. They felt that the topics covered were relevant and useful for their in-house research. In the feedback received, they agreed that the training objectives were met and participant interactions with the resource persons were encouraging and the knowledge received by them will help them in drafting and filing of patent applications. They further suggested organizing the future trainings for a longer duration as it will be more informative to the participants and they will gain more knowledge.

Conclusion
The training was effectively concluded with practical sessions on drafting. The training also received overwhelming response from the participants and its sessions were found to be informative by the participants.
